Did some of the players join LIV just to play the first weekend and get pushed out, sacrificing their tour eligibility in the process?

I think only 18 or 19 were PGA Tour players. So the question is, if you’re not a member of the PGA, do you still get punished?

Which then also applies to those who resigned.

The statement released by the PGA said they will be banned from all PGA tour events, including the Korn Ferry tour and some others. I am thinking about some of the guys who may have been able to play the Korn Ferry and make up to the big PGA Tour in the future, but they lost lifetime eligibility to play 1 LIV event before being replaced by Patrick Reed.

That doesn’t sound legal.

Quote:
U.S. Department of Justice investigating PGA Tour for behavior toward LIV Golf

The U.S. Department of Justice has opened an investigation into the PGA Tour's handling of its players and whether it has engaged in anticompetitive behavior during its ongoing battle with the LIV Golf Invitational Series, a new circuit being financed by Saudi Arabia's Public Investment Fund.

The inquiry, according to player agents who have been contacted by DOJ officials, is focused on the PGA Tour's actions regarding the Official World Golf Ranking, warnings it has issued to players who were contemplating joining LIV Golf and suspensions that have been levied against players who left by PGA Tour commissioner Jay Monahan.

A PGA Tour spokesperson confirmed the DOJ's inquiry to ESPN. The Wall Street Journal first reported details of the investigation Monday.

"This was not unexpected," the PGA Tour statement said. "We went through this in 1994 and we are confident in a similar outcome."

.....................

One of the issues that is being closely examined by the DOJ, according to another agent, is whether the PGA Tour, DP World Tour and the governing bodies of the majors are conspiring to not award Official World Golf Ranking points to LIV players. The 48 players who competed in the first two LIV events were not awarded world ranking points.

.....................

In 1994, the Federal Trade Commission investigated whether the PGA Tour had violated federal laws by requiring its members to obtain permission from the commissioner to play in outside events and appear on other golf TV programs. The FTC ended that probe without penalizing the PGA Tour.

....................

LIV Golf CEO Greg Norman, a two-time Open champion, has argued that professional golfers are independent contractors and should be allowed to play wherever they want.

"Surely you jest," Norman wrote in a letter to Monahan in February. "And surely, your lawyers at the PGA Tour must be holding their breath. As has been widely reported, you have threatened the players on the PGA Tour, all of whom are independent contractors, with lifetime bans if they decide to play golf in a league sponsored by anyone other than the Tour.

"But when you try to bluff and intimidate players by bullying and threatening them you are guilty of going too far, being unfair, and you likely are in violation of federal law."

Yup, like I said, what the PGA is doing doesn't sound legal...

The key legal point would be whether they have a non compete clause.

No, because it’s antitrust laws. Can’t clause your way out of antitrust violations. That would defeat the purpose of antitrust laws.

Quote:
DOJ launches antitrust probe into PGA Tour's handling of LIV Golf's emergence: report

https://www.foxnews.com/sports/doj-antitrust-probe-pga-tour-handling-liv-golf

If their actions are found to be in violation of antitrust laws, then the existence of any clauses will not matter. Because violations of antitrust laws are illegal. And you can't have a clause which allows you to commit illegal acts:

Quote:
What Are the Antitrust Laws?

The antitrust laws are a system of California and federal laws that prohibit unwarranted restraints on free and open competition in commerce. These laws allow the Attorney General to bring civil and criminal legal actions against individuals and businesses acting in restraint of trade. District attorneys can bring similar actions for antitrust offenses centered in their respective counties.

Furthermore, the law provides that anyone injured by an antitrust offense may recover from the wrongdoer three times the damages suffered.

---------------

Antitrust violations are not just ways of doing business – they are serious crimes for which the penalties are severe. If anyone inside or outside your company asks you to violate the antitrust laws, they are asking you to commit a felony for which you could go to prison.

https://oag.ca.gov/sites/all/files/agweb/pdfs/antitrust/antitrust.pdf

The DOJ is investigating whether the PGA's actions falls under the following category:

Quote:
Other agreements among competitors

In addition to price-fixing and bid-rigging, any other agreement among business competitors which restrains competition is usually illegal. For example, boycotts (agreements by competitors not to sell to particular customers or not to buy from particular suppliers), market or customer allocations (agreements among competitors affecting to whom or where each will sell), and output limitations (agreements among competitors to limit overall quantities marketed) are almost always illegal, regardless of justification.

Joint ventures undertaken by competitors can be legal, within certain limits.

Example: Two shoe manufacturers agree to stop selling to a discount shoe store because its retail prices are deemed too low. The manufacturers have engaged in an illegal boycott.

https://oag.ca.gov/sites/all/files/agweb/pdfs/antitrust/antitrust.pdf

This is the action that might fall under the above category:

Quote:
One of the issues that is being closely examined by the DOJ, according to another agent, is whether the PGA Tour, DP World Tour and the governing bodies of the majors are conspiring to not award Official World Golf Ranking points to LIV players.

So the question is, is the PGA tour afraid to compete against LIV? LIV wants to compete against the PGA.

Is the PGA trying to avoid this competition by trying to hurt/kill them before they even get off the ground? That's the question.

It does seem clear that they don't want LIV to get off the ground.

So the PGA has to prove that their actions has nothing to do with LIV. They're not afraid of competing against LIV. They have other motives for their actions, and it has nothing to do with trying to destroy their competitor (LIV golf). That's what the PGA has to prove.

Their suspensions/banning of players has nothing to do with trying to hurt/kill LIV before it gets started. They have good reason to not award World Rankings Points to LIV golf, and it's not to hurt/kill them...

On its surface, it does seem clear that their motive is to hurt/kill LIV. But, can the DOJ find enough evidence to prove it?

Let's see.

Bottom line, you can't use your powers to try to hurt/kill your competitors. Your competitors can die on their own due to natural and fair competition. But they can't die because you used your powers to hurt/kill them.

Quick thoughts on The Open:

Looks like Tiger will fail to make the cut for the first time since his comeback from the car accident.

Mark Calcavecchia with a brutal +21 score after two rounds. Might want to hang up the clubs even with the lifetime exemption Calc.

Great leaderboard with several of the LIV Rebels right in the mix like Dustin and Bryson.

Tiger was out of contention after the first day...he was 14 strokes back of the leader. Missing the cut was not a surprise. Unfortunately, that leg injury from the automobile accident will probably be a physical handicap for the rest of whats left of his golfing career.

If Rory doesn't go -2 over the final 4 holes, he will be in the second-to-last group tomorrow with...Dustin Johnson. Please, golf gods, let this happen.

Ugh, Hovland holed out for eagle from the fairway coming down the stretch and then birdied 18, so he will play with Rory tomorrow. What a missed opportunity for golf. I'm actually hoping that it's a showdown on Sunday between a PGA Tour golfer and a LIV golfer. I want all the drama I can get.

So in regard to Calcavecchia, there was a reason he was allowed by the R&A to tee it up one final time. Former champions are exempt to play The Open through the age of 60. So the 2020 edition would have been his final time, but that year's event was canceled due to COVID. He was going to be allowed to play last year, but he was injured and coming off surgery so he couldn't play. So the R&A allowed him to play this year as a swan song. Nice gesture by them.

McIlroy looks like he is really locked in to me.

This would seem to be his golden opportunity to win another major after a long draught.

Links golf so different, very interesting to watch.

Didn't realize that, probably was too hard on Calc but it couldn't have been a whole lot of fun for him shooting a +21 in two rounds.

I thought it was a lifetime exemption but I guess that is only for the Masters and maybe the PGA?

Great to see Rory at the top of the leaderboard and Victor right there with him.

Go PGA!

I'm rooting for Rory but I have been waiting to see Victor break through and win a major. He's been threatening for the last 18 months or so.

Yeah. I like Victor a lot. Definitely a true rising star. He's one of the guys I'm always rooting for.

As far back as the stats go, Rory McIlroy is the only player to hold the 54-hole lead at a major, hit every green in regulation in the final round and not win.

The guy shoots a 64 in the Final Round including a 30 on the back 9 to break Rory's heart.

Just incredible golf by him and a very deserving champion.

Props to Cameron Young also, watch out for him as he has more firepower than just about anyone on tour.

Charles Barkley will be talking to LIV and might have to give up his TNT position if he takes the job.

If they get Fehrety and Barkley as the announcers, a TV deal becomes more likely.
