In 1994, the Federal Trade Commission investigated whether the PGA Tour had violated federal laws by requiring its members to obtain permission from the commissioner to play in outside events and appear on other golf TV programs. The FTC ended that probe without penalizing the PGA Tour.

LIV Golf CEO Greg Norman, a two-time Open champion, has argued that professional golfers are independent contractors and should be allowed to play wherever they want.

"Surely you jest," Norman wrote in a letter to Monahan in February. "And surely, your lawyers at the PGA Tour must be holding their breath. As has been widely reported, you have threatened the players on the PGA Tour, all of whom are independent contractors, with lifetime bans if they decide to play golf in a league sponsored by anyone other than the Tour.

"But when you try to bluff and intimidate players by bullying and threatening them you are guilty of going too far, being unfair, and you likely are in violation of federal law."

No, because it’s antitrust laws. Can’t clause your way out of antitrust violations. That would defeat the purpose of antitrust laws.

If their actions are found to be in violation of antitrust laws, then the existence of any clauses will not matter. Because violations of antitrust laws are illegal. And you can't have a clause which allows you to commit illegal acts:

This is the action that might fall under the above category:

So the question is, is the PGA tour afraid to compete against LIV? LIV wants to compete against the PGA.

Is the PGA trying to avoid this competition by trying to hurt/kill them before they even get off the ground? That's the question.

It does seem clear that they don't want LIV to get off the ground.

So the PGA has to prove that their actions has nothing to do with LIV. They're not afraid of competing against LIV. They have other motives for their actions, and it has nothing to do with trying to destroy their competitor (LIV golf). That's what the PGA has to prove.

Their suspensions/banning of players has nothing to do with trying to hurt/kill LIV before it gets started. They have good reason to not award World Rankings Points to LIV golf, and it's not to hurt/kill them...

On its surface, it does seem clear that their motive is to hurt/kill LIV. But, can the DOJ find enough evidence to prove it?

Let's see.

Bottom line, you can't use your powers to try to hurt/kill your competitors. Your competitors can die on their own due to natural and fair competition. But they can't die because you used your powers to hurt/kill them.

Quick thoughts on The Open:

Looks like Tiger will fail to make the cut for the first time since his comeback from the car accident.

Mark Calcavecchia with a brutal +21 score after two rounds. Might want to hang up the clubs even with the lifetime exemption Calc.

Great leaderboard with several of the LIV Rebels right in the mix like Dustin and Bryson.

Tiger was out of contention after the first day...he was 14 strokes back of the leader. Missing the cut was not a surprise. Unfortunately, that leg injury from the automobile accident will probably be a physical handicap for the rest of whats left of his golfing career.

Ugh, Hovland holed out for eagle from the fairway coming down the stretch and then birdied 18, so he will play with Rory tomorrow. What a missed opportunity for golf. I'm actually hoping that it's a showdown on Sunday between a PGA Tour golfer and a LIV golfer. I want all the drama I can get.

So in regard to Calcavecchia, there was a reason he was allowed by the R&A to tee it up one final time. Former champions are exempt to play The Open through the age of 60. So the 2020 edition would have been his final time, but that year's event was canceled due to COVID. He was going to be allowed to play last year, but he was injured and coming off surgery so he couldn't play. So the R&A allowed him to play this year as a swan song. Nice gesture by them.

This would seem to be his golden opportunity to win another major after a long draught.

Didn't realize that, probably was too hard on Calc but it couldn't have been a whole lot of fun for him shooting a +21 in two rounds.

I thought it was a lifetime exemption but I guess that is only for the Masters and maybe the PGA?

Charles Barkley will be talking to LIV and might have to give up his TNT position if he takes the job.

If they get Fehrety and Barkley as the announcers, a TV deal becomes more likely.
