Oh, and just to be clear, the jury rejected the “sudden passion” argument.

Never, ever, did I think that a guilty verdict on the murder charge would happen. Though it is richly deserved.

Unfortunately, I think that an appeal of that verdict will occur. I don't know what the legal possibilities are there, whether an appeal could force a lesser charge or whether it would mean there'd have to be a new trial. Perhaps AH (or someone else with legal expertise) could advise.

The exclusion of the expert will be one issue. Otherwise, I don’t know of any appealable issues. Dallas (like Houston) had a blue wave, so the court of appeals is not full of pro-police types. She will have trouble selling mistake of fact as a matter of law. I would say that her prospects are poor.

I am on a Facebook group for Texas lawyers, and a couple friends of mine are high profile, well connected criminal defense lawyers. If I hear an educated discussion of the appellate issues, I’ll come back and report.

Thank you.

I'm still awestruck by the grace and humility of Botham's brother. I couldn't have done that.

And who are we to criticize him for choosing to forgive. In this hellish and nightmarish scenario, that was the rare light of goodness.

10 years is too little, especially with parole at 5 years (which she will likely get). How the police handled the investigation makes you worried about the timeless protection of the blue code/line.

Rest in peace Botham.

I don’t know that there has ever been a similar case. You would need to analogize to other police shooting cases or to other cases with failed self-defense claims, but sentencing is individualized. I would say that the sentence is on the lower end of what was expected, but it was not the minimum.

10 years. Is it adequate justice? Probably not. Is it a potential sign of things moving in the right direction? Hopefully so.

Seriously. I was worried for a sec too.

10 years isn't nearly enough.

If she wasn't a cop she would be serving easily double. (let alone being a white woman).

Emotions run high in and outside of courtroom after Amber Guyger sentenced to 10 years for Botham Jean's murder

I say she should blame the force for not recognizing she was afraid of people and possibly afraid of her gun. Why afraid? She held it as an item that murders people not an item that can gain the authority needed to protect the peace.

Her social media memes were what made me wonder if there was possible intent/premeditation.. but the sexting before arriving home wanting to go further led me to realize, or have hope, it was her fear and trigger finger that killed him

I agree with Omar.. after Costco I was sure this person would get an odd probation for her "accident"

10 years is enough to get current cops attention.. they will be found guilty and sentenced.

You have the Trump white evangelical version of Christianity.

Then you have Botham Jean's version.

Which is more compelling?

Trey here.. US Imperialism and Capitalism seek to crush Jeans version.

*I find it very interesting that the sight of such true compassion and oneness can bring most any human to the point of holding back tears. Is it something in our species that was supposed to be more like that and we cry because we know we have that power too but refuse to express it?

Botham looked and was said to be an Incredibly Big Generous Soul, We can all say a prayer of Thanks that Botham has siblings from His beautiful parents.

Botham's family said it best today.

You can forgive.

But there must be consequences. 10 years is a light consequence for what she did but that's what the jury decided.

Not to be stereotyping but this does not look like the average mistaken identity drive by shooting neighborhood

Her partner should have been called in on the stands to talk about anything she ever said about Botham.. This could have also put notice on his head he was a part of the case.. This could easily be her partner .. her lover and cop partner.. now lone wolf.. the citizens didn't sell their souls and protect a cop this time.

I thought she was gonna get manslaughter. But admittedly I don't know the details of the case.

I still think there is a possibility she somehow planned this killing? Heartless throughout the whole episode.

Quote:
Guyger claimed to have performed CPR on Jean, but the lack of blood showed she had not, prosecutors said. The 911 call appeared to back up that evidence.

If nothing else this sentence is a warning to police officers to respect human life. This chick had serious emotional problems.. Extreme disregard for human life

>>This officer knew she just unloaded two point blank death rounds into the mans heart. She was more worried about losing her job....

"I (expletive) up," the second stated.

Jurors also heard the Guyger's 911 call.

"I'm an off-duty officer," a breathless Guyger said in the recording. "I thought I was in my apartment and I shot a guy thinking he was, thinking it was my apartment."

"You shot someone?" the dispatcher asked.

"Yes, I thought it was my apartment," Guyger responded. "I'm (expletive)."

As Jean lay dying, Guyger appeared more concerned about the repercussions she would face.

"Get up man," Guyger could be heard telling Jean in the recording. "Hey, come on, man."

The dispatcher reassured Guyger that help was on the way. "I know, but I'm …," she said, sounding near tears. "I'm gonna lose my job."

That statement is enough to make sure she does time^^ That brain with a gun and badge is a serious threat to YOUR Safety...

hmm. I dont feel sympathy for her.... even if it was a pure accident. people do things that are accidental all the time and they have to go to prison. it was her fault all the way.
