J.R. Smith wasn’t charged after a heckling New York fan accused the Cavaliers guard of choking him in 2015 .

But, back in New York, the former Knicks guard has run into potential trouble with another fan.

TMZ:

Law enforcement sources tell us … they got a call around 2:30 AM on Sunday morning from a guy who says he tried to take a picture with the Cleveland Cavs star outside of The Park, a hotspot in Chelsea.

Smith allegedly turned the fan down — telling him no photos — but he snapped one anyway

We’re told … Smith allegedly approached the fan and snatched the phone out of his hand and then launched it into a nearby construction zone. The fan claims his $800 phone was damaged and he has filed a report with police.

It is unpleasant for someone to take a picture of you without permission, but Smith didn’t hold a reasonable expectation of privacy on a public sidewalk. The fan would have been within his legal rights to photograph Smith.

We’ll eventually see what’s determined about whether Smith followed the law.

I can see this guy going off the rails if Cleveland sucks and keeps him there.

"This is nonsense and we're not going to respond to nonsense," Smith's attorney, Alex Spiro, wrote in a statement to ESPN.


On July 26, a man told police that Smith grabbed his cell phone and threw it into a construction zone in Manhattan after the man tried to take a picture of Smith.

J.R. Smith said he’d rather cover his tattoo than lose money in fines.

But the Cavaliers guard will pay a fan who accused Smith of grabbing, throwing and breaking the fan’s phone.

Shayna Jacobs of the New York Daily News:

Assistant District Attorney John Johnsen said the offer to the Cleveland Cavaliers guard was an “adjournment in contemplation of dismissal,” which means his criminal mischief rap would be dismissed and sealed after six months of good behavior once the NBA veteran accepts the deal.

Smith will also have to pay $600 in restitution to reimburse the 20-year-old admirer from Pennsylvania who stopped to take the ex-Knick’s photo on 10th Ave. near W. 18th St. around 2:30 a.m. on July 29.

At least Smith can put this behind him now.

They have the right to buy out the final year of his contract next year for $4 million, which they'll probably do. So they can just cut him if it gets too bad.

They had to part ways after this:

"I don't think the goal is to win," Smith told The Athletic. "The goal isn't to go out there and try to get as many wins as possible. I think the goal is to develop and lose to get lottery picks. I think that was always the plan."
